Property can be taken back from children who do not take care of their parents after receiving the property as a gift.
The Supreme Court has given this decision while interpreting the law made in 2007 for the protection of the interests of the elderly.
In this case of Chhatarpur, Madhya Pradesh, the court has cancelled the gift deed made by the mother to the son.
The court has ordered the son to hand over possession of the property to his mother by February 28.
Section 23 of the 2007 law states that after the enactment of this Act, if any senior citizen gives his property to someone by way of gift or in any other way on the condition that the recipient of the property will take care of the senior citizen, in case this does not happen, it will be considered that the transfer of property has been done by fraud or threat, and the tribunal will declare such transfer as void.
